These Terms of Service (“Terms”) govern your access to and use of the CasaVoz website and the purchase of our products. Please read them carefully. By using our website or purchasing our products, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website, placing an order, or otherwise interacting with CasaVoz, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use our website or purchase our products.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to purchase from us. By placing an order, you represent that you meet these requirements.

3. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted on this page. Your continued use of our website or purchase of our products after changes are posted constitutes acceptance of the revised Terms.

4. Products and Descriptions

We strive to describe our products accurately, but we do not warrant that product descriptions, images, colors, specifications, or other content on our website are accurate, complete, reliable, current, or error-free. Product colors may appear differently depending on your display. Specifications and availability may change without notice.

5. Product and Installation Disclaimer

CasaVoz hardware is a low-voltage consumer smart-home product. The CasaVoz Thermostat operates on standard 24VAC HVAC wiring. Installation and service should be performed by someone comfortable working with low-voltage wiring, or by a qualified HVAC professional. You are responsible for confirming compatibility with your system before installation.

Our software, APIs, and agent skills are provided as tools. You are responsible for the actions you, your AI agent, or any automation take using them, including any setpoints, schedules, or other device state changes.

6. Orders, Pricing, and Payment

All orders are subject to acceptance by CasaVoz. We reserve the right, in our sole discretion, to:

  • Refuse, limit, cancel, or reject any order for any reason
  • Limit quantities purchased per person, household, or order
  • Correct any errors in pricing, product descriptions, or availability, even after an order has been submitted

If a pricing or description error is discovered after you place an order, we will contact you for confirmation at the corrected price or cancel your order and issue a full refund. Payment is processed at the time of order through our payment processor. All prices are in U.S. dollars unless otherwise stated.

7. Shipping and Risk of Loss

Shipping terms are described in our Shipping & Returns policy. Title and risk of loss for products pass to you upon our delivery of the products to the carrier. We are not responsible for delays, loss, damage, or theft that occurs after the carrier takes possession.

8. Returns and Warranty

Our return and warranty terms are set forth in our Shipping & Returns policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

EXCEPT FOR THE LIMITED WARRANTY EXPRESSLY DESCRIBED IN OUR SHIPPING & RETURNS POLICY, OUR WEBSITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, CASAVOZ DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CASAVOZ OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR WEBSITE OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, OUR WEBSITE, OR OUR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless CasaVoz and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the website or products; (b) your violation of these Terms; or (c) your violation of any rights of another party or applicable law.

12. Intellectual Property

All content on our website, including text, graphics, logos, images, photographs, and software, is the property of CasaVoz or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

13. User Conduct

You agree not to:

  • Use the website for any unlawful or fraudulent purpose
  • Interfere with the security, integrity, or performance of the website
  • Attempt to gain unauthorized access to our systems or data
  • Use automated means (bots, scrapers) without our consent
  • Violate any applicable laws or regulations

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of our website or products must be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

18. Dispute Resolution

Before filing any claim, you agree to first contact us to attempt to resolve the dispute informally. Send a written notice describing the dispute via our contact page. If we cannot resolve the dispute within 30 days, either party may proceed with formal legal action in accordance with Section 17.

19. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Shipping & Returns policy, constitute the entire agreement between you and CasaVoz regarding your use of our website and products. Our failure to enforce any right or provision will not be a waiver of such right or provision.
